Can owner force us to take vacation when he closes his company?

Company closes every year for a week at years end. Owner sent out a memo stating that we MUST take 5 days out of our vacation time during the week the company closes. I have worked in this company for 4 years, i entitled to 10 days vacation but with this new policy, i am only entitled to 5 days of vacation. Can he force us to take our vacation when he closes his company?

Yes, there are no laws requiring employeers to allow for scheduling of paid time off. You state in your question you now have only 5 days of vacation but i think what you are saying you only have 5 days you can schedule when you want. If the owner is still paying you when your off it is still vacation time.

Yes he can. He certainly doesn't have to pay you for it, so he's doing you a favor with taking vacation. And since vacation is a benefit, he's not legally required to give you ANY. So if you get five days of your choice, and five days during shutdown, you are getting paid for 10 days that actually he wouldn't legally have to pay you for.

Yes. It happens all the time with certain employers who have similar "closed" seasons.

Vacations are not mandated by law. You are not owed vacation -- it is given by the employer so he has the right to change the rules. In some states the only rule labor departments will enforce is to say that employers should follow their own policies.

Yes he can make you take your 5 days then. But he still needs to give you your other 5 days that are coming to you.

Yes he can, it is the company right to choose this. I know we just went through this with my company. It was a major blow up.

Most companies that do long shutdowns around Christmas say that you can either use vacation or take it as non-paid time off. Some even allow you to borrow from next year's vacation time. This helps with vacation liability also.

The company is not required by law to give you any vacation. The vacation days that they give you they can put limitations on. Sorry.

Actually,in most states,your employer MUST pay you vacation time(at least five days worth). Now the sick time,they don't have to pay if you get fired or quit.

The bigger issue here is that he has to pay you for days you can't work because of his actions. Like if he closed for remodeling, and you're a salaried employee, you still get paid for the days you are closed for construction work to happen.

He just wants you to take your vacation then so that he doesn't have to pay you for the 10 days you're entitled to, in addition to the 5 days he's closing for his own vacation. It's a pretty scummy thing to do!
