Can reason for discharge be disclosed in employment verification?

I was terminated last year for failing a drug test. I had never been disciplined by that company in the 3.5 yrs I worked for them; can they disclose the reason for termination when an potential employer calls for verification

Depends on the state, but in most cases, the former employer won't disclose it because of liability reasons.

Judy
In most places, it wouldn't be illegal if they gave the reason, but most companies don't.

Yes. A former employer can provide truthful information about a former employee. A former employer can even provide his/her opinion of a former employee as long the former employer explains it's his/her opinion.

Fred
Used to be, no one would ever reveal the reason for discharge for fear of lawsuits. Now, things have changed because I could end up hiring you, not knowing about your failed drug test and end up in a situation where you become a liability. Courts are no longer quick to find fault with disclosing the reason for discharge as long as it does not release private information and a failed drug test is not private.

as long as it is the truth they can tell anyone, some companies may not tell others will, there is no law that says they can't contrary to popular belief

No, most states do not allow the former employer to answer specific questions pertaining to a former employee the only question they are allowed to answer is, "Is this person higherable or not?" to which they can only answer "Yes" or "No".
