Can she take legal action?

This may seem a bit ridiculous, but please hear me out.

I went on a school overnight trip to another state. During this trip, we had a game show. If a contestant buzzed out of turn, they had to do something embarrassing. My teacher did this, and had to sing an embarrassing song. Before she put on the performance, she told us all not to tape it.

Of course, being the rebellious teenager I am, I taped it. I posted it on facebook, and tagged many of my friends in it. She saw it, and called me, requesting that I remove the video, so I did.

My question is, since I am graduating this year, can I post the picture after I am out of the school? Can she take any kind of legal action against me regarding the video? I assume that she can't since it's not any sort of explicit material. What if I simply blurred out her face and didn't let her identity become known in any way?

Some people touched a little on it, but didn't take it far enough, so I will. If for some reason she is fired because of that video, yes. She could sue you. Defamation of character is one cause of action that comes to mind. Emotional distress is another. Just because it was in a situation where she didn't expect a certain level of privacy is not an umbrella of protection. She did ask for you not to tape it and you've already admitted to us and the world that you understood and were perfectly capable of understanding that you violated her wishes.

I agree with all the posters that are advising you to just not do it. Part of graduating high school is learning that you are no longer a child. It makes you look mean, and advertises to the world what a creep you can be. Don't forget that potential employers can and will look at your Facebook and determine what kind of human being you are. Post that and you tell the world that you have no respect for your elders and are immature beyond comprehension. But that is just my opinion.

Can she take any *legal* action? Probably not, because it sounds like she wasn't in a situation where she had a reasonable expectation of privacy. She might be able to appeal to Facebook and have them remove it, depending on their policies at that time.

But, bigger issue here: I know you're still a kid, but quit acting like a child and just leave the video off Facebook. You weren't supposed to videotape it anyway. If anything, you owe her a major apology for even taping it in the first place.

She might be worried about what would happen to her if any of her co-workers or her boss see it. Did she do anything she wasn't supposed to do or that might seem even the least bit unprofessional? (You as a student might think not, but she might see it differently.)

Even if you blur her face, the situation shown in the video (and the comments on it, and the people tagged, and the fact that I'm sure people already know you have this video) might be enough for a lot of people to figure out who it is. You can't control if people figure out who it is.

You *can* post the picture. That doesn't mean you *should*.

You've been asked not to post it. Why would you be so rude as to do it anyway?
