If somebody is signed off from work with stress, can they still go to work in their second job? Can they only do this if the stress is work-related? Additional Details It is not me, so don't yell at me that I shouldn't be skiving. I am just annoyed at somebody else who has left me short-staffed and given me and everybody else more stress so they can be off with stress

no, if you are saying your un-fit to work you are un-fit to do all jobs, un-less you had a job where you had to be on your feet all the time and a second job where you was sat down, if you broke your foot you could still do the sitting down job but not the other job.
but if you are saying your stressed out you can not really be doing one job and to ill for the other |

Really doesn't sound like a good idea.
An ex-colleague had a back problem which meant she had real problems sitting at her desk for long hours - but when she was spotted doing her 2nd job (carrying out demonstrations of various products in stores), even though she was doing something that did NOT hurt her back she was reprimanded at her main job.
She also wound up her colleagues as THEY had to shoulder her work load when, to them, she just appeared to be skiving. |

There was a girl that worked for my company that called in sick ALL the time, however, she managed to go to her second job with no problem, she lost her first job when they found out. |

There is no law against this, but that person may be courting problems with the first employer.
If disability or sick pay is being collected, other issues are raised, however...you do not say whether or not this is the case.
I can see situations where one would be able to cope with one job, and be too stressed with the other-ever watch Chef Ramsey? |

It kind of depends ...
A doctor is well within his or her rights to sign someone off from only one of their jobs and not the other.
But if the person is completely signed off, then they shouldn't be working either job.
This applies without it mattering what the sickness is caused by (i.e. whether or not it is stress).
Without you going into detail about the situation it's impossible to say for sure, but if the two jobs are different in nature then it's quite reasonable to assume that there are some things that the person could do and some things that they couldn't, meaning it would be appropriate for them to be at one job but not another. There could be loads of different reasons.
At the end of the day, it doesn't matter right? I understand that you are annoyed that you have been left in the lurch by this person. But, they are legitimately signed off so they wouldn't be at your workplace anyway, so the fact that they are going to work somewhere else shouldn't really matter to you. |

It depends...I'm a firefighter and if you hurt your back or have some kind of surgery or something like that ...and you can't fulfil your duties as a firefighter but ...let's say on your days off from the fire dept. you work a desk job or something less strenuous and you have a dr.'s excuse stating specifically what you can and can't do...then it is perfectly legal. Not sure about stress |

Its another version of moonlighting. as long as you dont let your first job suffer too much. Think of it as working two jobs and the shifts overlap.
The only time you have a real problem is if your second job is in conflict with your first.

Technically, there is nothing wrong with using your sick days off for something that isn't a sickness. I have heard that a high percentage of people in middle-class jobs take sick days for events that are non-illness or work related.
But this raises morals issues of obligation to your work. If what you are asking is if it is allowed, then no. You could possibly lose your job if somebody that you know from work finds out.
Considering stress relation causes. WStress is often seen as a type of disease. It is allowed to be classed as sickness in the workplace (often people such as Police Officers, Surgeons, Councellors deal with stress issues as they are constantly in a fight between resolving other peoples' issues). And just like how a person can be admitted into a rehabilitation camp from suffering from an addiction, if you provide evidence that doing the other job is letting you relieve the stress, then I see no reason why they could refuse you the right to work.
After all, working as a stress reliever lets you actually work as in the workforce. There should be no rules or laws forbidding this action as long as you provide visual or oral evidence from a professional that doing so will help you with your problem to get back to your work. |

I would say yes assuming two things:
1) You are able to prove with documentation, such as a doctor's note, to your first job that you had reason for taking sick leave.
2) You have contracted a sickness which is not contagious, so as to not put your coworkers at your second workplace at risk of catching the same thing.
Given these two conditions I'd say your clear to do it. |
