So this is pretty much a long story short.
I was talking to a girl through myspace who wanted to trade me her macbook for my camera and a cell phone(a good sizes value) I was selling my camera and cell phone anyway on there so I thought that would be fine. She wanted me to send same-day because she was leaving the next day(today) for 8-10 days and would not be able to ship out. After I sent my items(the post office did not offer me a receipt might i add) I saw her on another myspace users "scammer" list. So i had questioned her about it, and after a ton of different reasons why she was on there, all bashing the other user, i figured i would ask her to take a picture of the receipt that she said she had gotten. She came up with NUMEROUS reasons why she couldn't take pictures.
Another thing is, she has changed her name multiple times on myspace. How I know is because she was scamming other people through the different names, but giving them all the same address. Now she says that her and her mom looked into it and she told me that there is nothing that any of us who have been scammed by her can do about it. I do have an address, name, and two different phone numbers that she gave me.
I am just wondering if the macbook doesn't come in the mail, if there really is anything I can do about it.
This has made me so sick over the last few days because I don't know what to do. Thanks.
by the way, I know I don't have a receipt from the post office saying i sent my items out, but i do have EVERY conversation and every myspace message saved from her and also from the numerous other users who say they have been scammed by her.

I would take her to small claim court, do you have emails to say she received those items? |

Make copies of all of your documentation, and report this to the postal inspectors.
As to your maiiling of items, you don't get a receipt unless you ask for it. You can pay extra for confirmation of mailing or of delivery. |

You should have asked the post office to send the package insured and "Return Receipt Requested" which means that she would have to sign showing that she had received the package.
Since you didn't do either of those things -- you may be out of luck. She can claim that she never received the items, and you have no proof that she did.
E-mails and MySpace messages are not legal proof of anything. Neither are comments made by other people. |
