Can they fire me for this?

I want to start off by saying this was my second time calling off work and we have a attendance policy if you miss so many days they will give you a warning then a write up then termination I called out today because I had to take my little girl to the hospital because she had shortness of breath and then my supervisor called me and left a message on my voicemail saying she just happen to come in today and she noticed I called out of work and shes going to have to let me go because I didnt go to work can she do that. I called her back and said my daughter is sick and I dont have nobody to help me with her I only call out if it has something to do with my kids and she said if I work weekends I shouldnt never call out of work and I told her do she want to see my baby doctors note she said she soory she sick but I dont want nobody calling out of work mind you this other girl did 2 no call no shows and they didnt do anything to her.

Sorry this happened, but yes, they can fire you for practically any reason they deem valid except for discrimination. You might consider calling your supervisor (or going in person) with documentation from the hospital, and calmly explain the situation to him or her. But you never know......they might have had other issues with you and this was just the last straw. Couldn't hurt to try to talk to them though.

It depends on just what the labor laws in your state are, and what the policy about termination says on the application you signed. Most employers cover their *** by having on the application that they may "terminate at will".

Well the answer is unfortunately yes. More than likey you are in a "right to work state" which empowers both the employee as well as employer to terminate any contractual work agreement you have at any time without prior noitce. You should consult your employee handbook or contact a member of human resources to try and further resolve this if you feel this supervisor singled you out for harsh treatment. if you are unaware of the policies, you really dont have a leg to stand on unfortunaty.

If you live in an 'at will' state, you can be terminated regardless of what it says in the manual. Last time I heard, there were 34 or 35 states that were 'at will'...meaning that you could be shown the door at any time.

You can secure a lawyer, IF you really want this job...or just resign, thank them for their efforts, give them two weeks notice (in resignation letter) and find another job.
Also, if you feel if you are being 'forced out', then you need to take the matter to your state unemployment bureau in order to collect or see if you can collect, bennies. Make sure you have a copy of the company policy on leave with you...if possible.

Depends on if you are in the "probation period" which is a period at the beginning of when you were hired that usually lasts 3 months. If you are not, and there is a policy set, she cannot fire you for this as long as you called in properly.

You could see an attorney about disparate treatment, but don't expect much to happen.

Your supervisor is a Friggin MORON. Don't worry, that is to your advantage. You need to call HR immediately. Did you know that just the fact that you have a claim against the company for calling you up by telephone and firing you on your answering machine. That is cold and callous, and a number of other things. They are also cold, callous and uncaring that you needed to take your daughter to the hospital.

And ON and ON and oN.....YOU need to contact your HR department immediately.

when they hired you they might have given you a rule book of the company, if they did you can look up the attance policy of the company. usually they say the first 30 to 90 days you are on probation of your jog which means attance, attitude and work habits and such. also the h. r. in you company should have a copy of that too and they should help you out if they are good at their jobs. i was out with problems with my knee and they knew it i had a Dr's. note and they wrote me up and such but that is why i quit , my story is way different but they still hassled me.

No...they can't fire you for that...there must be another reason, and your boss sounds wicked...you ought to leave her a 20 piece bucket of original recipe and a freight box of twinkies and let her know what she can do with both of them in her office. Don't forget to give a bottle of diet root beer soda either.

I wouldn't pursue working there. What an awful policy. Get yoourself a good job where the boss understands what having a family means. Good Luck!

FYI....I would l check out this website. I dont know how long you have been working for this company, but FMLA does protect you and your immediate family for medical emergencies. There are restriction as to if you qualify for the program. You have to accumulate so many hours in a calender year and the condition that is being treated needs to be determined as a serious illness. If you daughter has asmtha or something similar I am not sure whether a doctor would consider that a serious illiness. Anyways, all the information that you will need can be found in the attachment for the Department of Labor. Good luck!

I would get ahold of an attorney. I don't believe she can do that for two days. You have a legitimate reason for calling off work. Seriously. I mean who do these people think they are anyway? I would really talk to an attorney and look into a lawsuit. The attorney can represent you for free, and make the rotten company pay your legal fees. I hope your daughter is better and try to find a better place to work. Good Luck and know that not everyone is so nasty in the workplace! AND P.S. I know that the state I live in has a at will policy, that they can supposedly fire you for no reason. I spoke to an attorney and that is not true at all. Check out the link below!

illegal if your daughter has serious illness or disability. there is a law that says you can call in sick to take a sick child to the dr. just bring note from your child's dr. and she will have to give you your job back. if she doesn't, you can sue the company.
