Can you be denied employment based solely on religious observations?

My younger sister was applying for a job at a restaurant - she has great experience and great references, and complete availability besides sunday mornings due to church. She said the person interviewing her said he's really sorry but "we have lots of people here who would like to have sundays off" and that if she would consider working sunday's he would consider hiring her. He said she had a great resume/application, but she'd have to compromise her religious involvment/observation to work there...
she obviously declined, but I'm wondering - isn't that illegal? or are some employers allowed to require you to be available 24 hrs a day 7 days a week... i just dont get it.

nowhere in the job description or duties did it say you must be available sundays... that's why i'm wondering.

In the case you described, your sister was not hired because of her unavailability, nor because of her religious beliefs. This is perfectly legal.

if thats specifically part of the job role to work sundays then he can say that fine.

religion or not - the job required sundays - so she has to find a job that she can have off n sundays....it was nothing personal....and not illegal

I think employers have a right to hire or not..if they require sundays then that should be their right. Its a free country. Your sister needs to find a job that is closed on sundays its time for Americans to be able to run their companys to their specifications and not cater to every religion in sight...jeez my religion says don't work on sunday keep it holy but guess what..I work every sunday nite 7p-7a. I have to side with the owner.
