YES
having a green card is not a protected group (in and of itself) however ............
IF the employer used that information to make an employment decision based solely on national origin then that would be protected and therefore illegal.

Yes. Some jobs require you to be a US citizen. Mostly government jobs and government contractors that require a security clearance. |

If that was the stated reason by the potential employer that a job offer was not extended, under US Law that would be illegal; the "silver lining" might be that no-one in their right mind would want to work for a business that was that ill-informed, there's no telling what else they might have wrong!
Not hiring someone specifically because they are a Green Card holder rather than a US Citizen is a violation of anti-discrimination law, specifically:
"Citizenship Status Discrimination
The law requires employers to treat U.S. citizens and legal immigrants to the U.S. on an equal basis.
There are two limited exceptions to this rule:
Where federal, state or local laws, regulations or contracts with governmental entities require employers to hire only U.S. citizens. For example, some state laws require police officers to be citizens.
Where an employer selects an equally qualified U.S. citizen instead of a non-citizen. This exception is narrow. The employer must decide on a case-by-case basis at the time of hire, recruitment, or referral that the two applicants are equally qualified based on the actual requirements of the job. Employers cannot use this exception to discharge an employee.
Please note: Although immigration law does allow these two exceptions, such actions may violate other federal, state or local civil rights laws."

Yes, any government jobs require citizenship.
I have been to a job fair and usually law enforcement jobs require citizenship.
Most of private companies do not care as long as you have either EAD or GC. That's all they care. |
