Can you be fired if...?

You tell a co-worker on your lunch hour that your husband had an affair. The other woman and her husband were said to be swingers and didn't care about destroying another marriage. This conversation made someone uncomfortable and I was forced to resign. This conversation happened on my unpaid lunch hour. When I was asked to resign or be terminated I was told this was unprofessional behavior and that I had broken a policy? I was telling a personal story to coworkers on my own unpaid time.... how is that grounds for removal?

The conversation was not on company time - it was on an unpaid lunch hour. It did not take place at the office - it was at a local restraunt.

Since you were not discussing work-related issues or breaking confidentiality of your clients outside of work, I don't understand how they can fire you.

I would call the labour board and have them follow up.

It sounds like your employer was interfering in matters which neither concerned him/her or your employment contract.

"Forced to resign" ? You should have made the company fire you and suffer the legal consequences. I feel sure that a lawyer would have very little trouble prosecuting a case like this.

that sounds horrible and i'm sorry for your loss of a job... did you read through your policy at work? maybe it has some answers but i'm sorry i cant help much more than that

This is the most silliest thing I ever heard.

This conversation was off of work and if the person was uncomfortable with the conversation she should have stopped it.

when someone files a complaint about another co- worker usually there is an investigation and possible disciplinary actions that take place. You should have received a warning and that is reaching because it was off of work.

The company had no right in letting you go because of this and I suggest that you talk to HR and or upper management to resolved this matter and or contact your local EEOC office. I would also recommend that you file a petition to see your personnel file, if your state allows this.

Wait, what? That's bull. I would be pissed. If I were you, I would march right back to wherever you worked, and ask to see a paper that clearly states that what you did Isn't aloud. Or, you can join the military, and NOT get fired. :) Good luck! God bless.
