As phrased, having a note from doc is the cause of a termination. I think you mean you were fired because you missed work, and that you have a note from your doctor. Yes, any more, evil politicians have made it OK to say that everybody serves "at the pleasure" of the employer, and hence has no rights. A step closer to slavery, but yes you can be terminated for any or for no reason.

Depends on the state you live in. Texas, for example you can be fired for any or no reason.

Yes, if you are gone a lot they can fire you for excessive absences no matter what the reason....a job is not like grade school.......good luck and go to work.

Yes, you can. If your company qualifies for FMLA leave and you file the correct paperwork for it, then no. But if this final absence was not the only one, and you have a history of attendance problems (arriving late, leaving early, calling in sick a lot) then they have grounds for termination.

It really depends. As other answerers have said, quite a bit depends on the state in which you live. In most States today an employer can fire you for any reason. Contact your State Labor Relations Board. If the illness that kept you out of work, however, is covered under the Americans with Disabilities Act, then it becomes a Federal matter and an employer cannot legally discriminate against you. We need a little more information to answer accurately.

It depends where you live. I know where I live, they can let you go for unexcused absences but if you have a legitimate illness which requires many visits to the doctor's office, it's against labour laws for them to fire you. Also look into your hiring papers and see if there is a clause in that regard.

Because its so different from region to region, the best thing you can do is contact your local labour board and find out what to do in your particular situation. I've seen cases where people were unlawfully dismissed and the companies had to pay out a severance package because simply hiring that person back just wouldn't work out. The reason for this is because receiving the same treatment and preference as all the other employees is very highly unlikely given what might have happened when that person was fighting for their rights.

Depends on a number of factors. How long have you been in the job, reason for the dismissal, any previous disciplinary history etc. Best bet is to have a word with Citizens Advice if you aren't sure of your ground (or try your trade union if you have one)

Yes you can.

Most companies have policies on attendance, and if you don't meet their requirements, it doesn't matter why, or if you have a note from a doctor for being off work.

A doctor's note has no legal force with your employer. If you have used up all the sick time you are provided, your job does not have to be held, even if you have 10 doctors writing notes.

Be aware as well that employers know how easy it is to get a doctor's note. Many folks can simply call the doc and say they need a note and doc's staff will write one.

If it's a day or two or even a week companies will try to work around you not being there if you have a Dr. note and you called in sick and didn't just not show up. The key is to let them know what is going on.

If it's a chronic problem, there are other factors involved as they have the right to continue to run the business without hardship due to absences.

The short answer is yes, you can be fired for cause regardless of if you were out sick or not.

it depends. where i work if you are going to miss more than three days of work due to illness or injury with a doc's note you have to take a leave of absence. you can remain gone for up to twelve weeks and be given your position back. but if you are gone longer than that you can come back, you just aren't guaranteed that position any longer. also, doc notes are not excused absences there either. there are very few things they do excuse. but somewhere else i used to work didn't have a problem with that. so......it just depends on where you work and what you do. and laws very according to state...its not all regulated federally. good luck.

I'm not sure what you mean. Do you mean if, say, you were having sleeping problems and had a note explaining. The next day you were found sleeping on your desk (death by powerpoint, hah hah) and you were fired. In that instance, that would be unfair dismissal.

But you need to give more details!

If you started swearing at customers and blamed it on a sleeping problem, then you definitely would be fired.

It depends on your past history with your employer. If your constantly sick w/o a doctors note then yes. But if you had a legit note from your doctor then not really but they could bring up your past and yes get fired.

You can't be fired for being sick...it falls under discrimination laws...i'd check your state laws and if you DO get fired, then I'd contact an attorney....

If you have a note from your doctor stating you cant go to work due---you shouldn't get fired. You may not be making 100% of your pay. Depends on your company.
