Can you be forced to transfer positions and take a near 50% pay cut without warning or agreeing?
Find answers to your legal question.

Can you be forced to transfer positions and take a near 50% pay cut without warning or agreeing?

First off, my employer gave me a 90 day review after I had been working in the job for 6 months. It was a negative review and was incorrect. I submitted a rebuttal against every point made (i.e. I did not receive appropriate training for the job). Anyways, I was essentially put on a 30 day probation. I talked to my HR manager about other opportunities within the company. She told me there was one and gave me an idea of the pay. I showed interest bc I felt I would never be treated fairly by my supervisor after submitting my rebuttal. The next day, my HR manager said she made a mistake and the pay was actually less and now I am training my replacement. The pay cut is nearly half my salary and I never agreed to this! This has happened all in this week (talk about xfer) and my last day is in about a week. This just doesn't seem right... I am considering getting a lawyer, but just don't know. I am in an "at-will" state. There are a lot of other wrongdoings that probably just couldn't be proven. Like the amount of unpaid overtime etc. I really like this company, but the way it is being run is ridiculous.

Unless you have a contract, the company can unilaterally assign you to a new position and change your pay.

I would strongly suggest finding a new job. You've already stated that your boss gave you an unfair review, and now they've changed the deal. Did you get a letter from the employer stating the new position's duties and salary?

It sounds to me like the employer is trying to get rid of you. Do you really want to work at place that does not respect you?

They could demote you or fire you, or reduce your pay, even without the negative review. They don't need your agreement. Your option is to quit.

Well, because you had a performance review that wasn't a good one, they can decide how and where to "place" you - if not in your current position. This doesn't require you to "agree" to it and it doesn't require giving you notice.

Since you are at the company for a short period of time, they actually can fire you for any or no reason, as long as it is not due to protected status (Disability, gender, age, orientation, religion).
Your options are very limited. If you refuse the new position, then effectively you have resigned.
