Can you draw unemployment after loosing a temporary job that lasted a year?

My friend has been on this job for a year, It was full time but only temporary but they just now decided to let her go b/c they didnt need her anymore. I dont understand why they wouldnt just hire her but anyways they said its possible they may call her back again to work but she doesnt know when they could be. So my question is could she apply for unemployment? That was her only income and she might have to come stay w/ me or her mom in the next month is she doesnt find work or some source of income. A year on a temporary job is a long time so I was wondering if she's eligible for unemployment. Thanks!

I feel so bad for your friend. If she was working directly for the company on a temporary basis she is entitled to unemployment. It would be considered a layoff. If she was still getting paid by the temp agency then no because she can be reassigned somewhere else. Tell your friend next time she is on an assignment to tell them she wants a temp to perm assignment no longer than 6 months. I know she needs a job but things like this can happen if you don't specify what you want. Tell her to sell herself to the company. I would have told the temp agency if this company isn't hiring me within 6 months then I want to be considered for something else. I would stay on them no matter what. Tell your friend good luck.

It depends on the state you live in. If she was hired on a temporary basis but was paid through the employer's PAYROLL processes, then in some states she's considered an employee regardless of what the company called her.

If the company paid her through their Accounts Payable processes, and didn't deduct any state or federal income tax or the FICA taxes, then she's clearly been considered a contractor, a non-employee. In some states she can get unemployment and in some she can't.

The only way for her to get a determination as to whether or not she is eligible for benefits is for her to go to the Employment Security Commission office (or whatever your state calls it) and apply. No one here can give you an answer because every state has different laws, and we don't know where you are. Help your friend figure out where she needs to go to apply and encourage her to get it done. The worst that can happen is she'll be told she isn't eligible. The best that can happen is she'll start getting benefits checks.

well it depends where you are ? Australia or England or
America ?.......... I can answer for Australia and say,
that if she is out of work....no matter what her job was
she claims for unemployment.

But the rules are......to recieve money she must prove she
has applied for other simular jobs or any job and that she
has actual proof of going to interviews.....or the money
stops!!
Also the unemployment office will want proof from the last
place she worked that they let her go, they have to give it
in writing !! So if she even wants to go back, that is beside
the point......the X employer must give a separation certificate
when an employee is let go.

Yes, it depend on if that employer actually pay into unemployment funds. Not all agencies( staffing company s do so).
Now the next thing is, did she work there over six months with a good working record?

I think it depends on who was paying her. If she was working direct hire on a temporary basis by the employer then she may be entitled to collect something. If she was working for the company through an agency (a temp service) then she may be entitled to nothing because she would still be under contract with the agency and therefore could potentially be offered another job.

She should be entitled to unemployment yes,
Here in Ireland if your employer has let you go from your work, you are eligible for payment from the social welfare, it usually takes a few weeks for all details to be sorted and for your claim to be finalised,
She should contact her local welfare office either in person or by phone, and try and sort everything out with them, xx

Yes she can and even if a person was full time employment and had their hours cut to part-time, can collect umemployment. If in the United States this is the web address: www.fluidnow.com and she can sign up on-line, receive the check either in mail or direct deposit.

It depends on how she was paid.

If she was paid as an independent contractor, she paid her own taxes etc etc, then no, she is legally self employed and can not lay herself off.

If she paid via a temp agency then no, she is still employed, she has not been laid off and just needs to ask for another assignment.

If she was paid through the companies payroll department then yes, she worked for them and was laid off from her job. They should have provided her a pink slip (it really is pink) to document this with EDD. But, it is OK if she did not, EDD will contact the company to verify she was actually on payroll and laid off, not fired or quit.
