My partner is currently on suspension on full pay at work for making a silly mistake. He has an investigation pending. He is really unhappy with the way his company have treated him and would like to hand his notice in and look for a new job. However, as he cancelled his 1st appointment for investigation because it was to be held by his manager's sister and he didnt think he would get a fair hearing, I am worried that if he hands in his notice now they will stop his pay from the date he was suspended, therefore he would lose a months pay which we really can not afford. If he hands in his notice would he also still have to work the months notice his contract outlays, and how will this work considering we don't know yet when he will be returning to work as he doesn't know when his investigation will be held yet?

Might be useful for you to know the reason of his suspension. He is the only one to have a safe key. He fell asleep and was late for the nights trading session so they could not open the safe. He had previously worked a 90 hour week and so is claiming his mistake was due to tiredness. The letter he was sent stated he jeopardised a nights trading, caused loss of revenue and failed to carry out his general duties. However the club still opened at it's normal time, they just traded for half an hour with no change in the tills. When my partner arrived he was suspended on the spot.

If hes on full pay with a pending investigation and he handed his notice in, he WOULD be liable to return the payed leave hes taken already.
He has to come to an arrangement with his employer, and get it in writing he wont be made to pay it back.
Why not continue the investigation and look for a new job at the same time? This way he is getting some income in still.
Once he finds a new job he can then speak with his current employers to come to a resolve.
Most likely they want rid too, if they are suspending him for a petty mistake, so will probably be glad to end his contract. |

he has to go to the meeting or his pay can be stopped. On suspension on full pay an investigation and meeting to resolve it must be carried out no later than 2 weeks, contact ACAS if you are in UK. |

With further knowledge of why he has been suspended then do nothing follow the procedures take friend or union rep to take notes and also remember you can ask for as many comfort breaks as you want during the hearing.
After the hearing and you have a copy of there notes which you are allowed a copy too if not a member of a union then go too your nearest C.A.B office and let the duty solicitor see the notes |

Employers have this thing nowadays of trying to push people around because they know people need thier incomes. I would suggest that if money is the issue, play the role with them, as long as he is getting paid while on suspension, but definately be looking for a job. Unfortuantely, they have his back against the wall. If he feels like he has something to gain stick in there, but if by any chance the both of you can make it with your income (assuming you work) I would tell them to kiss my azz. I would make sure that i met with the person who started this suspension crap and tell him personally in his face. |
