My friend cant put gas in his car pay his rent pay his utilitys cause he recently lost one of his jobs he haves to have to to struggle to get bye and the other job he has they take 80% of and took all his unemployment check to get caught up on everything he is giving up on life .. He has no money for a lawyer either and no family to live with here this is fcked up!!! Additional Details This is based on three separtely cases keep in mind

80% is a big chunk and such a decision by the family court is legal. He must be in some serious arrears (owing a lot of back child support and probably more than 1 child involved.) He can return to court to lower the monies due because of his loss of income, but it depends on the judge and how much in arrears he is in. Sorry about your friends situation, but as they say you made your bed you lie in it. Obviously your a female. How would you like being left with a kid to support on your own? How do you think the mother pays for the doctor, food, clothes, and all those other things a child needs? Only one here who is fcked up is your friend. I really hope you never find yourself in his ex-girlfriend, or ex-wife, or whoever she was to him... ever find yourself in her shoes. You will not be feeling as sorry anymore. |

No - generally, the state can't be sued - but there are lots of lawyers that will help. Search the web for ones that advocate father's right. |

OK what he needs to do is contact the child support agency at the county seat. Bring the divorce decree or whatever has the amount he needs to pay on it. He also needs to bring copies of his monthly expenses, a copy of his pay stubs for the past month & the unemployment paperwork. He needs to sit down with someone and see what will work as a living wage for him and how much he can give for support. He will go into arrears, but this way he has a legal standing as towards why and might avoid arrest. |

You cannot sue the state. Perhaps if goes to his local child support office and proves his income, he can have his payments reduce. This will not eliminate his arrears or change the amount of his monthly payment that is due. However most states have a maximum percentage that they are supposed to take as garnishments for child support. |

I'm sorry he is dealing with this situation. Actually he may not be able to afford a lawyer but he can afford a law firm. He needs to get a Pre-Paid Legal Plan immediately. It will give him access to one of the top law firms in his state for the price of a cup of coffee a day. Check my source.

I think he is in the position he is because he did not pay support regularly they do not deduct until they have too. So now he is doing catch up. Once he is caught up it should not be too bad. In the meantime maybe he does need to try to get a second job. He doesn't have family but he has a friend. Allot of guys in his position try to get room mates to off set their expenses until things keel out! |

If the courst based his support on dual income then he should petition the courts to lower his support amount according to his lowered income due to job loss |

Well he shouldn't have ha a kid, they cost lots of money and I can bet that the child support doesn't match up to what the parent that has the child most of the time spenss, tell him to get a better job or another one ... he can't sue the state, what he can do though is go back to court and tell them he isn't making as much money and needs a reducement on child support! |
