Can your job require you to stay beyond the scheduled time?
Find answers to your legal question.

Can your job require you to stay beyond the scheduled time?

In NC, can your job require you to stay beyond your scheduled time? Let's say, for example, that you are scheduled to go home at 6pm. When 6pm rolls around, can they hold you for longer? Also, if they haven't specifically told you that they want you to stay longer, can they punish you later for clocking out when they did want you to stay beyond your scheduled time?

My fiancee was just told that when she closes (scheduled to leave at 10:30pm) that she should just expect to leave at 10:45 instead. But if her schedule says 10:30, does she really have to stay?

I realize those are a few questions, but I appreciate everyone who takes the time to answer.

this is how it works, if she refuses to stay they can fire her, if she files unemployment she will be denied as she would have been fired for cause. if the company needs you to stay than that's the way it is, contrary to what the other poster said there is not a 48 hr notice law or anything else for that matter

There can be such a thing as mandatory overtime, but they must pay you for that time

If they pay for the extra time, it's OK since they are allowed to adjust the terms and or schedule. If it's over 40 hours you should get time and a half. If not, then it's illegal and violates the labor laws, but only for the pay issues. There is no law for that prohibits an employer to require an employee who will work late. They can let you go and legally hire someone who will adhere to their terms and condition of employment.

No, the employee is not forced to stay.

However, it may show that the employee is not willing to help the company and may be deemed undesirable and get the work hours cut if managment is unreasonable and giving short notice.

I am sorry I am not versed on NC laws. However, most schedule changes should require about 48 hours notification. I would not let this go below 24 hour period as it will be unfair to the employee. However, if the employee accepts short notice hours change, it will be a signal that the employee is willing to make concessions. However, most jobs should not penalize people for being willing or unable to change schedules on short notices. I am sure some managers may not feel this way.

In a nutshell, she can not be forced yet she can be "punished" through her work hours for anything.

Good Luck!
