I was terminated this January from my car rental company where I was a Branch Manager for 2 years and 7 months. General Manager came exactly at closing time and handed me a letter that I was terminated with absolutely no reason. I was a great manager with no write-ups of any kind, made them millions over my period of employment, and had no complaints whatsoever from my employees or clients. The company also made false statements about me stealing from them, with absolutely no proof which I added to the suit as personality damage and bad faith termination. They only paid me for 2 weeks after the termination (which is legally mandatory).
I sued the employer shortly after for 7 months of wages plus another $10,000 for mental distress due to damage to my personality and bad faith termination plus legal fees.
In June we had our first negotiation session, where the employer and their lawyer walked out on 5 minutes after they came because the employer was acting childish and did not want to negotiate. Even her lawyer said that he could not have her come down to earth with a reasonable offer.
3 days ago the employer filed for bankruptcy, and we have our pre-trial next week. My lawyer said that at this point there is no reason to continue the suit and that we should drop it and cancel the pre-trial.
I called their trustee and they just sent me a creditor's package because now I am one of their creditors.
Does anyone with experience in Canadian Employment and Bankruptcy law know how this could end up?? Should I really drop the suit or continue with it?? This company by the way was a Limited Liability Corporation or a Ltd. Also, I know that the owners had sold some of the vehicles at extreme discounts to their friends and family, and themselves. Please help me get an idea. Thanks to anyone who answers.

If the lawyer is on contingency, he is probably assuming that he is not going to get paid for his work or his court costs.
I would ask the lawyer about the possibility they had insurance (doubtful) and if you can sue them personally in their position as corporate directors (possible, but they could just claim personal bankruptcy).
If you know any details about the car sales, talk to the trustee, maybe they will cut a deal. At the very least you could get those people in deep trouble.

Those sales should be considered "concealing assets". It should also be considered criminal. I'd contact my attorney again - and contact the proper legal authorities. |
