Collecting unemployment?

My husband got fired from his job and he says he is going to go collect unemployment. At what percentage does it pay? What are reasons you would be denied?

There are differences state-to-state, but the general rules are:
1) He must have lost his job through no fault of his own. This is usually interpreted as meaning he was not fired for proper cause. Example: If he was fired because he missed too many days of work, he is probably not eligible for unemployment. If he was fired because his boss didn't like the kind of car he drove, he probably is eligible.

2) He must be willing and able to work, and look for work. That means he must be physically able to perform some type of paid work, and be willing to work. The rules on looking vary a bit, but it means he has to apply for a minimum number of jobs each week and report them to the unemployment office.

The best advice I would offer is to apply. If he gets turned down, appeal. Many companies will not show up to the appeals hearing, which makes him more likely to win the hearing.

The percentage paid depends on how much money he made to begin with - the more he makes, the lower the percentage 9since it caps out.)

Every state's UI is a little bit different so you would need to check with the office in your state - do a search online for "Michigan unemployment," or whatever is appropriate, to find the office in your area.

He can be denied if he left his job without a good reason, or if he was fired for misconduct - theft, substance abuse, fighting with another employee, insubordination, falsifying company documents, etc. If the company has documentation that they warned him previously and he did not improve, they wil have a strong case to prevent him from collecting UI.

Some companies pursue UI claims aggressively and others don't really bother - if he worked for a small company that didn't really have an HR person, they may not bother responding to the claim, in which case he might have a good shot at collecting UI.

To collect State Unemployment Benefits you generally need to be laid off your job.

Check out the local Unemployment Offices website in your area for more details.

The maximum amount you can receive is $322 per week for 26 weeks of Unemployment Benefits.

You can file for UE and the employer can protest the application in which case you would go before an arbitrator who will review the facts of the employment matter and make a decision.
