i was injured on a job had surgery , now it looks as though ,that i am going to be laid of (fired) and not given my job back upon release what rights do i have, i would appreciate advise thanks

the two issues are unrelated
workers comp pays temporary total disability or TTD (a percentage of your normal wages) and all medical bills until you reach maximum medical improvement or MMI. once you reach MMI and are released for work a permanent partial disability or PPD will be assigned and a settlement based on that percentage of disability. other factors used to determine the settlement include whether or not you can return to your previous career, your education, work experience, transferable skills etcetera...
being laid-off plays no role in this unless the lay-off is due to your inability to perform the job then it will be considered and a part of the settlement..... |
