I have a website and want to know if i can put on pictures of graffiti.
Would this be legal if i put who the picture is by and a link to the source website, or could i get charged with copyright infringement or something?

If the pictures were taken by you then no problem (99.9% of graffiti is illegal so no problem with copyright law there really).
If you are posting other peoples photographs then you need permission of the copyright holder to post the pictures on your site.
Just giving a credit is not enough.
If you do post without permission then the copyright holders could sue you for copyright infringement and it can be extremely expensive.

You would be committing copyright infringement against the graffiti artist. Creative works are automatically protected regardless of where they are displayed. Additionally, notable graffiti art is often painted with the permission or even paid for by the building owner. Today graffiti artists will often even sign their work with contact information (a phone number) and a copyright mark for such work. If the graffiti artists has registered the copyright for the graffiti artwork you could incur some very serious statutory penalties for copyright infringement.
Linking it to the source website and photographer will not only not protect you against copyright infringement claims, but if the photographer actually added additional elements to the photograph you could also be subject to copyright infringement claims by the photographer/website publisher as well for copyright infringement on the photographs.
If you want to publish the photographs without exposure to copyright infringement claims you should obtain a license from both the photographer and the graffiti artist. |
