Could I be fired for this???

Could I be fired for this???

Everyone knows money is tight. I was considering getting a 2nd job a few nights a week, until a co-worker told me to be very careful that I don't get caught because it would be grounds for termination. I think this is absurd. Wouldn't that be illegal termination? I live in Fl, so maybe it's different from state to state?

you can not be prevented from working a second job in any state unless you have a contract that specifically addresses that issue.
if your second job causes a conflict with your first either with scheduling or availability issues then many employers have a problem with that.
as long as you communicate your needs and you remember which job is your primary focus then you don't need to worry. if you have concerns speak with your supervisor or the HR department to ensure you have all the facts you need to make your decision.

your time away from work is your time and can not be controlled by your employer if they did control your off time then they would have to pay for that time as being on-call. some employers would like to control your personal time but legally they can not.

It's certainly not a law that you can't take a second job. But it's not illegal for a company to have a policy to file people who do.

Some places do not allow you to work 2 jobs. I currently work 2 jobs and they have no problem with it as long as it doesnt interfer with my hours with my first job

Medical and Business Information
You can work a second job most people do and your employer usually doesn't care as long as you are not working for the competition.

It's called moonlighting, and if you didn't sign anything when you started saying that you weren't allowed to moonlight, you can't be fired for it.

My intution tells me you can't be fired for this unless you sign a document stating so. I could be wrong though. I think exceptions would be , as an example, if you work for att&t and moonlighted for sprint, that would be reasonable grounds for termination. Also, if you work 9 to 5 and had a job as a late night bartender which caused you to lose sleep and affected your productivity, that would be grounds for termination.

You can only be fired if you work under a do-not-compete policy, and you are working a second job that could be considered "competition" for your original employer. Otherwise, while your employer may not like it, as long as you get all you work done and come to work like before, I don't think you can get fired!
