Today is my second day at a new job in mid-managerial position at an academic institution. I met one of my student workers today who commented it was her birthday and I said oh may I ask how old you are (i know I shouldn't have asked but I was trying to be nice and all at a new job), and she just smiled and said 19. Then I smiled and said "to be 19 again." Well the student postions in my department are being eliminated at the end of the fiscal year (a decsion made a year ago by my supervisor). And then today I heard in an unrelated event from months ago a soon to retire employee filed an EEO complaint against someone for Age discrimination.
So I've learned my lesson and will not inquire or mention Ages ever again in the workplace. And this wasn't a job interview, so can i get in trouble for asking this student her age?

Cathy, It was my 2nd day so I had no idea it was someones birthday, but I will consider the birthday card thing.

Not normally, EEO problems usually has to do with discriminating in hiring or promoting someone.
However, as a mid-management person, a better thing to have done was give her a birthday card. I always keep a stash of them in my desk for just that kind of situation. |

You are so over-reacting.
And just because someone filed an EEO complaint for age discrimination doesn't mean the complaint is valid or will be supported by the EEO.
Relax a bit. You'll have an ulcer in no time if you don't! |

i don't think so. you asked, she did not have to answer, you did not put her down for it, you did not discriminate against her for it, and she did not seem upset about it.
for a lawsuit to take place, there has to be damages, did it hurt her in any way? (to me, it doesn't sound like it, i'd say you won't get in trouble,) |

Good looking out on the violation of personal information.Somethings are not appropiate to ask in the workplace try to stay clear of personal issues and focus on work topics.You will better off to listen more than talking unless your people skills are required.Usually mangenment postions do require interaction with employees one on one, just becareful what you say. |
