My job went and put me on FMLA.. I hurt my back and I didn't file a report, which I know now I should have. I have been off over a month now.. The job took all my paid time off hours and gave them to me in a check, stating I had to use these hours because I didn't have my doctors papers sent to them in time so they wouldn't take my PTO, which I sent them the papers before a check was recieved.. I have no money at all coming in.. I am still in alot of pain and can't work.. I am getting therapy for a herniated disc.. The job doesn't even keep in touch with me at all to see if I'm dead or alive..
Could I sign up for unemployment due to this?

According to my policy handbook I see that you have to give your own money from your pay into the short term disability, which I didn't do at the time I started and never thought this would have happened to me. It's your money paying for yourself to be out with ill health.. Didn't hear of that one before, other jobs I have heard do that for the employee atleast.. Would have been nice if the HR lady would have explained this part when I started, guess I should have read the handbook thoroughly when I started there.

you must be willing and ABLE to work and actively seeking employment to qualify for unemployment insurance.

No, to get unemployment you have to be able to work and available to work - you aren't.
Even if you had filed for FMLA the first time you felt a twinge, they can still legally require you to use all of your PTO before the unpaid FMLA leave.
Doesn't sound like a very caring bunch you work for/with, to not check and see how you're doing, but what they are doing is legal. |

Unemployment is not available to you because you are still employed. Does your employer offer short term disability? Some companies automatically sign employees up for this, others you have to elect (if you have to elect and haven't then you aren't eligible now).
Check with your state. I know New York and California both offer state disability. Make sure all your employer paperwork is turned in (if it isn't this could take you off FM LA which means your job is no longer protected).
Find out who manages leaves at your company and give them a call to find out what the next step needs to be. |
