Could I sue for getting minimum wage?

I am getting paid 7.21 an hour and the minimum wage in Florida is 7.25. I would like to know if there's anything I could do because of getting paid under minimum wage. Could I sue? What would be the best option? Please help!

That's odd. What was the agreement when you accepted the job, in terms of pay? Did they say it pays minimum wage or below minimum wage? I'm just curious how you found yourself in this position to start with. Next step is - ask your boss. If you really know for sure the state's minimum wage is 7.25 (I don't live in Florida, so I don't know), then ask him or her - "why do I not earn minimum wage - is there a mistake?"
So, explore this with your boss first to figure out what's going on. You shouldn't always jump to "suing" someone as your first response to anything in life - check it out first. What if there is some mistake there? |

They paid you 4 cents less an hour? That doesn't sound like something anyone would be doing (why bother breaking the law for 4 cents?)
Are you sure you're not taking into consideration the taxes you would have been paying on your pay check?
Are you sure minimum wage applies to you? If you work for commission, or if you are in certain jobs like waitress (at least in Canada), there's a different minimum wage set because they are expecting you to get tips.
If you do qualify for minimum wage and you really aren't getting it before taxes, then start by talking to your boss. Sounds like it could be a clerical area. Suing them is going to cost more than the extra 4 cents you'll get anyway. |
