I want to know if I have a case, I'll provide all the details that I can possibly think of.
I was seeing a chiropractor last year, He suggested some orthotics and said they would help my back problems, They cost $250, but We agreed that my payments for these orthotics would be in small chuncks as I could afford it, I made 2 payments totallying 30 dollars, than I broke my foot,
and the break was specifically atributable to the wearing the orthitics, and because they broke my foot, I stopped payments on them, and stopped wearing them, and sent them back to the doctor, telling him I didn't want them anymore,
The doctor is telling me that he doesn't care that the orthotics broke my foot, he wants me to finnish paying off the $250 bucks.
I was going to be fine with just having him let me give them back and letting me not finnish paying for them, and I would have dropped the whole matter.
Now, I'm wondering if since it was his product that broke my foot, I'm wondering if I can go after the doctor for not just my 30 dollars back, but for all my expenses of having my foot get better, plus any time it cost me off work, and for my legal expenses should I decide to go after him.
Do, I have a Case.
Also, additional details, Some orthotics are well worth the 250 dollars they actually put your foot in a special mold, and build the orthotics to fit your foot exactly. This doctor did not do that, what he ordered for me was nothing more than a cardboard cutout, one size fits all orthotic.
Which After I got it, I saw the same thing in stores for 12 bucks, and i saw the same orthotic on a tv comercial for $19.99
So, this doctor is dishonestly going after people for 250 bucks a person, when the product is costing him maybe 15 bucks to give out to people, he's making a killing off of these fake pieces of garbage, instead of putting forth the effort to have them built with a mold of a person's foot.
I wish he would just let me go and call it even, but he wont, and now I'm stuck with owing another 220 dollars,that I just dont have cause i've been out of work so long.
What Do I do,
Do I have a case.

You could take him to small claims court but you better have good documentation to support your claim. |

You're out of job, you have no income - you broke your foot wearing his phony orthonic, he's a chiropractor. (not the same as a medical doctor) Find a Medical review board that investigates charges of malfeasance & misconduct - write them a formal letter, explaining your side of the situation without the misspellings and send a copy to your phony Doctor. If you can find a lawyer who will take your case on "spec" - that is 30% or more of the suit amount (50,000 - 100,000 whatever) go for it, otherwise get your life back together. |

Sounds like a case to me and winnable.
Talk to a lawyer that does malpractice suits.
If you win,you will get the contract canceled and all your money back plus court and legal fees and the Dr. will probably have to pay all your medical bills on top of that. |
