Could this be legal? What do you think? Please help?

My father has a job in finance and has been working with the company for a little under a year. Almost everyday he goes to work early around seven thirty and comes home late at night. Monday night he got home a 12 and last night at 1:30! I feel really bad for him because he tries his best. He is stressed out and isn't feeling well. His boss leaves everything to him and goes home, while they wont even let my dad take off when he wants to. The job does not pay overtime...i think i heard somewhere that this was illegal. is it? what can we do? he can't quick due to the bad economy and it is hard to get a new job. please help! thanks! We are in NY as well.

Your father would need to meet the FLSA (Fair Labor Standards Act) test standards to determine if he is in fact eligible for overtime regardless if he is salaried. One of the biggest things going on where employers are labeling the employees exempt when they are in fact non exempt. The hours he is presently working should end by the end of this month since it will be the end of the 4th quarter and preparing all paperwork for income tax filing. If he continues to work these kinds of hours then I am afraid to say it is not work related.

People who get payed by salary not hourly do not get paid overtime. The get paid a certain amount a year regardless of how many hours they put in. My husband is salary and there are weeks he works over 70 hours then every once in a while there will be a week when he only puts in 20 ( those are rare) regardless his paycheck is the same no matter what. Sorry your dad has been so run down.

Something doesn't sound right to me. I'm salaried and depending on the time of year I work between 40 and 70 hours a week. I'm only required to work 40 but make the choice to do what it takes to get the job done without complaining. Other than two months out of a year I have it pretty good. But I have worked early hours to late like your father every so often. If this is a temporary situation with the hours don't sweat it but if it's a long standing situation, I would be contacting labor relations. But never think our parents are perfect and it is possible there's something more going on that he's trying to protect you from finding out. Look into it a little more before drawing a complete conclusion is my advise.

If he is on salary and not wages, he can work whenever he needs to.
It is up to your dad to know how much or how little to do in one day.
Sounds like he needs to re-evaluate his work hours.
He only has to perform well; not perfectly.
He sounds insecure. Remind him gently that he really doesn't need to do so much. No reasonable person expects another to get sick from too many work hours.
The boss is probably more reasonable than he's been given credit for.

Your dad is a grown up, he is doing what is besst for his family.

If he earns a salary he is not paid over time. If he works by the hour he is, simple as that.
