Criminal background checks for employment?

Do criminal background checks for employment usually pick up CHARGES as well as convictions? I was charged with a felony, but was convicted of a misdemeanor instead...I know jobs would see the misdemeanor, but would they also see the felony charge?

It picks up everything. I could pick up that information now - If you were not a minor- with your name and a few clicks on my computer..Be honest or be screwed.

You should report it as it was. If you got convicted misdemeanor, that is all you did, and that is all they can ask. It is no ones business but your own what you were charged with, as you are innocent of that charge.

They can't hold charges against you, the question on the app is have you ever been CONVICTED, and I don't think charges show up, they are not part of the official record.

I don't know if you necessarily need to provide more information than what they ask for. If they only ask for "convictions", then tell them truthfully about the "convictions". Otherwise the job application would state "charges and convictions".

We all know that our society prides itself in allowing accused people the presumption of innocence unless proven guilty. You were NOT found guilty of that felony charge in a court of law, so the old charge should be a non-issue. Every day, there are people who get falsely accused by vindictive acquaintances, and even by overzealous prosecutors. It wouldn't be fair for them to have to list "charges" on their job applications for the rest of their lives even if they were found not guilty by a court, right?

So if the company wants "charges", then list "charges". If the company only asks for outstanding charges, then list only outstanding charges. If they complain, then tell them you were simply following their written instructions. But most companies that I'm aware of (unless you're trying to get some sort of high security clearance for a military contractor) requires only disclosure of convictions, if that.

If they ask if you've ever been charged then you should disclose the info. If they just ask for convictions then don't worry about the felony charge. Not disclosing it though could cause you to not get the job or lose it after being hired.

A background check will pick up the conviction, and the details thereof, including the charges filed against you.
