My husband had full custody of his daughter for the past seven years. Seven months, ago he changed it to joint custody with the biological mother due to a financial hardship. Since the child has been in the mother's custody, Child Protective Services in MI (where she resides) has been called. We live in Colorado and the child's counselor called Child Protective Services here due to concerns from the mother's home. My husband was told to file an emergency ex-parte in the state of Colorado by a mediator. We tried to file today, but were told we could not due to the original custody hearing taking place in Michigan. Is there anything that we can do in the state of Colorado due to all of the concerns and the fact CPS has been called in two different states on the biological mom?

I'd call MI family court and explain to them. You might be able to do something via fax, phone conference, etc. esp. since CPS is involved.... |

No, you have to file in the state where the case originates from. Sometimes you can file a motion with the state that the jurisdiction is in and get it transfered to another state, but if one of the parents still resides there it is unlikely. |
