Declining a new employment contract without resigning.?

I'm a member of a group of employees that have been required to apply for new jobs in an organization restructure. A large number of us have been shocked to find that whilst we are being offered new jobs in the new structure they are at substantially lower grades (in some cases equivalent to £12500 pay cut). No new contracts have been issued or signed as yet - so still working under our original contracts.
Question - Is it possible to reject these offers in a formal letter, using a legal framework to protect our rights, so that we have not dismissed ourself. Leaving the employer only tool of dismissal and us with at least some fiscal remuneration.

Call the law society in your city and ask them to point you in the direction of a good employment lawyer who can help you draft a letter.
You'll have to pay them and there is no guarantee that it will do anything, but if you love your current job, it might be worth it.
Also call your union. (even if you're not a member)
(on a personal note: why do you want to work for a company that thinks so little of your skills and abilities?) |

Basically, if your old job is not there has it been made redundant? If so they should be offering you suitable alternative work. Which they may feel is what they are doing. But if you don't accept it because you do not feel that it is suitable, then you can decline it and take your redundancy. (you need 2 years service to be entitled to a lump sum of redundancy)
If they will not give you redundancy and you feel that you are entitled to it and they dismiss you, you can appeal your dismissal and request your redundancy, by writing to the employer and asking for a appeal meeting, you are entitled to be accompanied by a trade union rep or a co worker. If you wish to bring anyone else it is by agreement with the employer. If you are not happy as a result of this you could but a claim in to the employment tribunal for unfair dismissal (if you have over 1 years service) and for your redundancy (if you have over 2 years service) To do this you can contact the Employment tribunal help line on 08457 959 775 or on line at www.ets.gov.uk and get an ET1 form. This form has to be filled in and returned within 3 months of the dismissal, for the unfair dismissal or 6 months for the redundancy. (but the sooner the better) |
