Discrimination?I was called and told not hiring on 3/7hung sign 3/10saying now hiring for same job.?

I have 18 years experience for the position i applied for.I believe i'm being discriminated against for a workmans comp suit i filed within the same company?
Additional Details
A person can not be discriminated against for a disability.My accident at work was not my fault.(faulty equipment).A quilafied applicant not offered a interview????? Anyone ever heard of dept of human rights,read their laws.

It isn't discrimination, if you filed a suit and they for some reason think that your own actions caused the accident or you had something to do with it they have reason not to hire you. Also they may not like the reason you left the last time or just don't like you. Seems like you should stop whining DON'T call your lawyer (not everything is a law suit) and apply for other jobs.

I don't know that you can call it discrimination - they don't want to hire you back for some reason, possibly because the comp case cost them big time. How can you prove that's the reason?

It isn't discrimination for a company not to hire someone who has filed a suit against them in the past. That's protecting themselves from another possible suit. They don't have to hire you just because you interviewed, and have 18 years experience.

discrimination would only apply if it was based on race/gender/religion/age... what you describe is a company not wanting to hire someone that filed a claim against them... They can do that... Think about it from their perspective... would you want to hire someone that had filed a claim against you? Someone that by doing so increased the cost of you buying workers comp insurance every year?

If they are now hiring, submit an application for the position. There is no discriminatory practice involved if the company opens a position in which you are interested after you have called to inquire about it.

If you apply and don't get the position, and you believe that you were discriminated against, then you can file a claim with the EEOC (www.eeoc.gov.) The company will have to demonstrate that they did not engage in discriminatory practices.

Realistically, your chances of prevailing in such a claim are pretty slim unless the company engages in obviously disparate selection processes. It is difficult to prove that a company didn't hire you because you had a previous work comp claim, as opposed to because they found someone more qualified.
