Dismissed for theft - What will my employers reference say?
|
Hi all.I was recently dismissed for theft. That's the nitty-gritty of what has happened.
In reality i was in a supermarket(who I drive for as an HGV driver) with my 4 children. My eldest girl grabbed a small bag of grapes and consumed them while we shopped.I kept the small bag and would usually pay for while putting the rest of them of the shopping through. This time I forgot.
I accept responsibility, attended my disciplinary and was sacked for theft,
I was however told that my story was believable and that I should appeal but dismissal is the only option available at this moment.
I am finding plenty of interest from new employers I have an unblemished work and attendance record and don't want to lie but what shall i say with regard to my leaving?

I would explain to them exactly what you have told us here. I would also consider appealing against your dismissal. Even if you don't want to go back to work there (I can understand that you wouldn't) it would be great to clear your name.
Do you belong to a union? If so, contact them for help. Also, a lot of solicitors do a free half hour consultation. It might be worthwhile booking an appointment to discuss this. You may be entitled to Legal Aid.
You must feel very let down by your employer's actions. Good luck for the future. |

In the UK your employer is within their rights to give a truthful reference.
It maybe worth leaving the reason for leaving blank and then explain it when you get to interview. If you have a clean record you could always volunteer to undergo a CRB check to prove that you have a clean record. |

The major for which I worked would not give any references at any time. They would only confirm the work history. They didn't see any benefit for them to give references to other companies or get involved in any possible legal entanglements like fighting over a dismissal like yours.
If you wanted references on performance you had to get them from individuals. |

It all depends on whether or not you live in a Right To Work state. If you do, it will probably just say something such as "failure to follow company policy". That is what you put on your resume. The majority of prospective employers do not ask which policy you broke. |

I believe that you should have appeal. See if you can go to a Citizens Advice Bureau and appeal. They will take on the case for you, whilst you look for work.
That is such a silly thing for a company to dismiss someone for. Maybe they just wanted you out, but this will soon show during the appeal hearing.
If they ask, tell them. If they dont ask, dont feel obliged to tell them. [ |

just tell them your daughters a thief not you, and that she is serving time and has promised never to steal grapes again.
your ex bosses are very petty. |

You should really try for an appeal.
Their reference will include that you were dismissed for theft so you will have to be honest with any employer you go to.
I can't believe they would do that it seems like an honest mistake. I know people who have shoplifted (intentionally) have been caught and let off (by the retailer, they never involved the police). |

All your employer can tell anyone who calls for a reference on you...legally...is the dates you were with the company. |

They can only verify dates of employment and position. They cannot state anything negative about you. |
