Do I have a legal case against my employer?

I work at a large public corporation. A few years ago, I sent an email to the top brass on ways to help our company save money (millions of dollars per year). They read the email, and sent it down the chain and my bosses got it. They were pissed since my ideas were ways to help streamline our department. Ever since then, my life at work was hell. I eventually had to report my manager to HR and he was reprimanded. My company recently had a lay off, and I was on the hit list. Other than this issue, I’ve been a good employee, won company awards, etc. I have seniority over others in our group – many of which have just been recently hired on. So my question is:

Do I have a case based on what appears to me as retaliation?

If the company hires a replacement for my job, would I have a case? What if the replacement is just a contractor and not a full-time employee?

You have a case if you can prove that your bosses actions after your email were retalitory.
It is hard to prove.
If he was reprimanded, then there must be something there that HR found.
Gather what evidence you have and consult with a lawyer.

You might want to read a book on Office Politics. Helped me understand corporate mentality. I understand your frustration. The laws regarding your lay off could be tricky.

It depends on what state you are working in. As a example in N.C. you could be laid off and a newer employee replace you since you made more more per salary or hourly. That alone could cost per hour is the only reason the company has to prove as a cost cutting measure.

It would be state specific except...If you are over 40 you are automatically guaranteed some protection under Federal Law. If you are under 40...your company may have a policy and procedure in the Human Resource manual that will deal with layoffs. That may give you a leg up in court. What you really need to consider is this...Is it really worth it? Although they can not officially state why they let you go or that you sued them word amazingly gets around. If it happens consult a Lawyer and then decided if the long-term ramifications are worth it.

In my state, if they lay you off, they have to wait 6 months before they can replace you...period.

I would consult a lawyer.
