Last week, we learned through a harassing phone call that my husband's ex-wife listed MY mother on a credit application as her ONLY relative. This was way back in 1995, and she apparently stopped paying on the credit card in 2003. The collection agency had her name, address, and social (my DH looked it up on old income tax records). It's clearly her, but she denies it (of course). We gave them her work number. At first, she told my mother that she had no clue what this was about, and later, in a matter of a couple of hours, said that she has legal counsel and is paying this off little by little. So, she obviously lies and can't keep her story straight.
I'm wondering if there's any way that we can go after her legally, not so much for using Mom's name, but because of the harassing calls.

If you do manage to find a lawyer to consider this, it is doubtful they would pursue it, even at a reduced fee. They would be interested in a more socially comprehensive effort and a few brief phone calls, while annoying, would not be consistent with the service expectations of "pro bono" work.
If your husband did not sign for this purchase, he is not responsible. Ask them to remove your family from their call list. If they call again, speak with a supervisor and request an email address or fax number to submit and document the request in writing.
Courtesy copy the "BBB" and the calls should drop off or even be eliminated altogether. Good Luck.

This is a serious matter, call legal aid, for a consultation (30 minutes) for a flat fee, they will direct you where you need to go, or what you need to do................you REALLY need to take care of this....
Or, you can go to an attorney that offers a free first time consultation. This is not just usuage of a name, but a SSN and an amount due??? correct........? which is in your Mom
name, in her credit report etc.
