Do I have to pay back an overpayment from a job I just quit?
Find answers to your legal question.

Do I have to pay back an overpayment from a job I just quit?

At the beginning of the month I took the only job I was offered and they said they paid twice a month. During that time I was offered another job and accepted it on the day paychecks were cut. Since the paycheck was mailed, I had not gotten it yet when I called my boss (who works in another state) to tell him I accepted another position.
When I got the check I expected to be paid for the first two weeks I worked and then get another check two weeks later for the remaining days, but this check was for the whole month (even the four days I hadn't actually worked yet). They then sent me a notice to pay it back.
I know the moral answer but since legal answers and moral seldom match, I was wondering was the legal side had to say.

Not a morality question at all -- legally speaking you owe them the money back. Isn't your money. They can take you to court to get it paid back ... easier to cut them a check.

Yes. Pay it back because it is the right thing to do.

You really answered your own question.

By your own admission it was an overpayment. You know that it is and it needs to be paid back.

Legally, if you keep the money for time you haven't worked, it is stealing and they most liekly will prosecute. Depending on how much money it is and how much they like/dislike you, they could seek federal mail tampering charges against you.

You are legally required to return the wages you did not earn.

Do what is right and pay it back. It is not worth getting into trouble!
