Do I need a lawyer for this?

I suffered a concussion on Wednesday at work and told my supervisor who did not report it. I called off work Friday to go to the ER for worsening symptoms. I've been home since then and no my job says workers comp may not pay anything becuase it wasn't reported that day (I thought that would be my supervisors job, she did nothing but hand me an ice pack and tel me to go to work)! What do I do?

Find employee health and request an incident or variance report and complete it ASAP. If you cannot go into the workplace to obtain one, have it brought to you or faxed to you...or emailed to you. This is imperative to have this information documented. Thoroughly describe the incident on paper. Document whom you reported the injury to, what time it occurred, and what was done following the injury. You must do this quickly. Do not ask if you can do it, ask for the paperwork and tell them you need to complete this ASAP.
If they get testy, tell them you are going to consult and hire a lawyer. Really it should not go that far, but that is an option.
This paperwork will save your rear end.
The lack of accountability in your supervisor shows.
Good Luck!

I would speak to a lawyer (just as a backup plan) and find anyone who can corroborate your story.

A. Always have written proof. Do you have something hard that says your boss knew about it?

B. Do you like your job? If not, call the lawyer and start a case.

C. If your going to do it, get a GOOD lawyer.

Yes, you need a Workers Comp specialist. You also need the doctors at the hospital to write letters supporting the concussion to be secondary to your employment. If you hire a lawyer, your counsel can protest the denial and obtain your medical records to support your theory of causation of the concussion. Most honest people do not fall and and immediately file an application for benefits under the Workers Compensation Act. You should contact a lawyer today. They are a high volume dealer and have someone there to take your history of injury plus your past medical history. TODAY.!

Your supervior is really stupid because she has put the business in a position to be FINED and fined HEAVILY for failing to report an injury at work!!

If the workplace is unionized, speak to your union steward immediately! If it's not, then consult with the workplace safety officer. If he/she told workman's comp doesn't cover this, he/she's even dumber than your supervisor. I would then report your case directly to the local labour baord/commission for the state/province you're in.

You are not at fault and you have rights in this situation. You may even have a serious legal challenge against your employer for failing to treat your injury properly!!

Best,
-- Liam

Get a lawyer. I had an accident and one of the first things I did was call my lawyer to find out my rights. It is nice to have people call it a bill I call it a benifit and they are very reasonable.

Speak to an attorney. I am not sure if your employer is being honest.

you go to human resources of your work place (if there is) and make a formal complaint,or is there a place for those kind of complaints in USA?because here in mexico we do have from those things, and we can make formal complaints about stuff liek that, and if they dont proceed, then you should consult to a lawyer for an administrative sue

yes. you may need an attorney ... it was a job related injury and the company you work for needs to take responsibility ... they have insurance to cover these things .
