Do I tell my future employer about a previous worker's comp claim from last job?

If I don't tell them... can they find out? Does an employer have the right not to hire me because of it?

An employer is not allowed to dismiss a potential canidate based on a prior work comp case.

I wouldn't necessarily volunteer your work comp history information to this employer.However, if they do ask, you should tell them up front and be honest about it. Their carrier does have access to look over past claims by doing an ISO index search. This will show them not only the past work comp claims, but also auto, MVA and civil injury cases. A search is not typically done unless there is a red flag or you have filed a work comp claim against them.

Also, if they do ask you about your work comp history and you happen to be untruthful, then they have a right to terminate you if they find out later on.

No, that is none of their business.

They cannot discriminate again people who have previously filed a wc claim.

If it doesn't come up in the interview.I wouldn't bring it up.

no you should not. this is not a question in their application . and they should not be looking for this kind of info. its agaist the law
