Do i have a wrongful termination case? ?

I was recently fired( my boss said we're "letting you go" as of this morning) for not "meshing well" and being "unpleasant to work with"(i was having a hard time with my medicine so i decided to stay to myself and not really convo with my coworkers. the only time i would talk would be about a patient. i didn't receive a warning or a meeting, nothing. i was just straight up fired. days later i called my boss and asked what exactly lead to my ultimate firing and he wouldn't give me a straight answer. he said basically that it was a lot of little things, none of which he elaborated on. i was on the job 15 months and i don't know what happened. I think that what he did is illegal and unethical. Should i pursue legal advice?

Highly doubtful you have a case. Most employers are at will meaning you or they can terminate your employment at any time.

More than likely the company needed to cut back due to the economy being bad but they didn't want to admit it to you and have you spread it around to all your old co-workers.

Start looking for a new job.

Depends on where you are located. If in the US, in almost all states you are an "employee at will" which means they can fire you for any reason not prohibited by law, or for no reason, so you wouldn't have any legal recourse.

As other suggests, if you are within those states that has a at-will employment statute or regulation. You will be out of luck as they can terminate you without reason.

However, if you believe that he made such decision based on your medical condition, the employer may have violated American with Disability Act or similar regulations.

If you have such doubt, try to contact EEOC or your state fair employment office for detail.

if you work in an at will state which most are they do not have to provide you with a reason you can be terminated for any reason at anytime as long as you are not a protected class

Well first thing is first..are you in a state that is employment at will?

Does your office have 15 or more people?

I see you were there for 15 months and no one ever disciplined you or said anything in your review? I would ask for copies your entire personnel file. If in fact you were sick for more than three days and you have 15 or more people in your company and you in fact work 1250 hours you were entitled to family medical leave. In order for them to prove that they fired you for just cause you would have have to know about situations that reflected performance. Did they give you a raise after your 90 days? There is a lot of questions that need to be answered. If I were you I would contact your local EEOC office a file a complaint. the EEOC if they see that there is a case will give you the right to sue letter which you would take to a lawyer Good luck.

I have been in HR for many years and there are many possibilities the company to go take into consideration before they let her go. She was let go with out any prior warning or knowledge of her performance. I think that you need to request your entire personnel file (Personnel Records Review Act) and look at the content of it. Check your state regulations to see how to go about requesting your file. Once you have review your file I would contact the EEOC and file a complaint.

Each state has different laws concerning employment. Most states allow you to leave an employer under your own free will, so the employer does not have any obligations to provide a job for you. Check with a local authority.
