Do i need a lawyer, i got hurt on the job?

I got struck by a forklift they didn't deny me workers comp can i sue the company for pain & suffering and loss wages. any advice will help

in the US generally NO
the employer is responsible for medical expenses and if you are out of work a percentage of your normal wages 66% to as high as 80% (varies by state) there is a minimum number of days missed before benefits start from as little as 3 days to as many as 7.
after you reach maximum medical improvement, MMI, if there is a permanent disability (partial or total) a settlement is paid based on the percentage of disability. your regular earnings, age, ability to work, train-ability for another job, education, acquired skills etcetera are used to help determine the settlement amount. pain & suffering are not a part of the formula however continuing medical treatment is.
you can get all the information you need on your state's web-site for worker's compensation. in most states an attorney is no longer needed due to the guidelines now being set by the states for all aspects of the process including the settlements. generally the only time an attorney is involved is if the employer denies the injury was work related. |
