Why wait till she is 65 if all this harassment etc has been going on , I assume over many years
All of these things may be true and if you do have evidence I suggest you take legal advice from a lawyer who deals with employment law .
At 65 I think any settlement won could be quite small , but good luck anyway . No one deserves to be badly treated at work . |

In order for a discrimination claim to succeed, the complainant is usually expected to prove, to varying degrees, that they have been treated less favourably on a specific ground such as age e.g an older person is treated less favourably than a younger person. Under Irish law the claimant is only expected to establish a prima facie case that discrimination may have occured after which the burden of proof switches to the employer who must prove that no discrimination took place. I'm not sure if UK law is different but as most modern labour law in the EU is based on EU directives the principles are probably the same. |

A similar situation arose at a company I worked for. The lady in question contacted ACAS and they directed her through her rights. She presented them to the company which backed down.
As a background the company management style was bullying with little regard for the employees.

No, you have an ex union steward in the house though.
If this person is a member of a union and you have such a strong case, then her union will be able to provide her with free, expert legal advice and representation.
If this person is not in a union, then she has made a very foolish mistake. The idea that she will get free legal representation anywhere else is ludicrous, particularly a test case. This person will have to use the money she saved by making to subscriptions, the pay rises that her union have won for her and that she did not contribute to, plus a lot more, to pay for legal representation. |
