Do you have the right to take a 30 minute unpaid break?

In PA:
An employer allows employes to take a 30 min lunch break. But one employee dosnt finish her work on time so her boss tels her she can't take her break today. Is this a violation of the labor laws??

Unfortunately, the employer is not breaking any law, but that is not good for employee moral!

She is allowed 2 15 min breaks and a half an hour for lunch. That is law. She might just have to stay late to finish her work.

It probably is but since you sound like you need to work then I would go along with it and find another job while I still have a job.

i dont know about PA, but in CA if you work over 6 hours on the clock, you are required by law to take a 30 minute break for lunch, regardless if you've done your "work" or not.

yes,it is definitely a violation of labour laws,because if she is not given a break,she would not be able to re-energise herself,and will become more dull and hence it would result in decrease in her efficiency of doing work

He can tell her she can't take her break YET, if the work needs to be completed first, but she still has teh right to take her break at some point during the day, and it's his duty as manager to make sure that she both finishes her work AND gets her break.

It probably is illegal, yes. You need to visit www.dol.gov; there should be a link to the PA dept of labor site. Depending on the industry your friend works in, the wage and hour laws may vary. Check under the "wage order" for the appropriate industry (healthcare, retail, food service, and so on.) Then look under "meal and rest periods."

As a general rule, employees are entitled to a 30-minute unpaid meal break for every 5 hours of work, unless their shift will end in 6 hours. They are also entitled to a paid ten-minute rest period for each four hours of work.

State laws vary but normally if you work a full 8 hrs, you rate 2 15 min. breaks and a 30 min lunch UNINTERRUPTED. One break in the first 4 hours and one in the second. If your lunch is interrupted, you should be paid for that half hour. Exceptions to this are Fire Alarms and other immediate emergencies.

Of course it is. Nobody can't go against the law, even if somebody thinks that he got a good reason to do so. Natural and legal law give you the right to feed yourself.
