The conditions of my employment have been changed recently but I have not seen or signed the new contract. I am applying for another job and I have stated my notice period as that which appears on my original contract as I haven't seen anything any different including my current salary. If I was to be offered the new job, do my current employer have the right to extend the notice period even though I haven't been made aware of it up to now?

no. they would have to prove that it was received by you and signed by you (that is the proof that you have received it) the only thing that doesn't make that hold up is if you are an union employee. by the union voting for or against a contract will make that contract null or valid and no signature has to be received. |

My first reaction is "No". For a contract to be binding, the general rule is that there must be a "meeting of the minds". That is, the parties to be bound by the contract must at some point have both understood the terms of the contract and agreed to those terms either in writing or by performance.
Did the employer, perhaps, post the new terms on a bulletin board or in a company newsletter that you didn't happen to see or read?
If not, I don't believe the company can unilaterally impose terms upon you without prior reasonable notice. |
