Does an employer have the right to fire a person after she makes a complaint about her manager?

My fiance was just terminated from her pharmacy technician job immidiatly after talking to her human resources mangager (in confidentiality) about her manager being unfair in the way he treated her and the other people she works with. Three other associates also talked to the HR about their manager that day, but my fiance was the only one who was terminated. My fiance is a very knowledgable and hard worker who has been unfairly terminated from her job and I'd like to know what her rights are. Also... is their anything we can do to retaliate within the law? Thanks.

Depends on where you live. If it's a right to work state, then they have the right to fire you for any reason. Pretty much unless you had a contract for employment (which is unheard of now-a-days) then you can be terminated from employment - it is at will for both sides.

Almost every state is a "right to work" state that means employment can be terminated at any time and for any reason.

File for unemployment right away. Schedule to talk to a person at the company higher than the manager.

If the other three workers told HR that the manager is fair, even-handed, and doing a good job, then what do you think they would do with your fiance? The above scenario is exactly what happened at a pharmacy I worked for once.

I live in a right-to-work state. I can be fired if they don't like the way I tie my shoes!

She isn't likely to have any legal rights to fight the termination. Is it fair? Maybe not. But nobody ever guaranteed that life is fair.

Agree with everyone here. I was once terminated because my supervisor did not care for my personality. It's not fair at all, but just as you may quit a job any time, your employer may fire you at any time. Not a subject they teach in college.

As with most things, this varies from state to state. If this is a large corporation, they probably have a non-retaliation policy. She should go back and talk to the HR rep about it. If not, ask for the name and phone of a Division or Regional manager.

In some states, you can be fired for no reason at all. Others are not so forgiving. Check with your Department of Labor as to what the law says in your state, and what your options are. You might also want to talk to a lawyer.

Forget some of the rude answers you are getting - I went through the same thing this past year. Contact the EEOC at www.EEOC.gov. (Equal Employment Opportunity Commission) They're job is to investigate things like this just as they are my case. They can get your job back, compensation etc.

If you can prove this and want actual financial return, consult a lawyer. If you just want the situation looked into, write to the Dept. of Labor. Yet, four people complained and only one was terminated. That might indicate there are other factors involved in selecting the one. You need to try to figure out why she was the only one terminated before you take any steps.

In general, retaliatory conduct by a company is wrong and can lead to an award of damages. The problem is proving it. "A after B" does not establish "A because of B."

I would contact an attorney that specializes in job related cases. I don't know all of the details of what happened so I don't know if you have a case or not .. They would not fire just 1 person if multiple people complained about the same thing on the same day. Are you sure they weren't taking the managers side to save their own butts and turned on your fiance? Just a thought..

No. Take your matter to the boss and if no action is taken, take to a lawyer or the labour department in your arear.
