Does anyone know the legal limit they can take out of your paycheck for Child support in the state of Virginia

I have tried contacting the Local Childsupport Agency and they give me the run around.

First - income is determined by the income of BOTH parents - so, they don't know an exact amount - because maybe they don't have both of your incomes.

Here in OH it's up to 50% of your (after taxes) check if you are remarried, or have other children to take care of. Or, 60% of your check if you have no other "family" obligations. No matter what cs asked them to take out, they cannot exceed these limits. You'll just end up with back support.

Here is a handbook for employers from the Virgina cs website. You will need adobe reader to access it. On page 5 near the bottom, is the break down on the limits that I was talking about, from the actual VA handbooks.

i don't think there is a limit, its based on "disposable income"
the more you make, the more they take.

did you check the support order. you can figure out how much by doing simple math

1. Is there a maximum amount of money that may be withheld from an employee’s paycheck?
Yes, for all income-withholdings, the upper limit on what may be withheld is based on the Federal Consumer Credit Protection Act (CCPA). The federal withholding limits for
child support and alimony are based on the disposable earnings of the employee.
The Federal CCPA limit is 50% of the disposable earnings if the employee supports a second family and 60% if the employee does not support a second family. This limit
increases to 55% and 65% respectively if the employee owes arrearages that are 12 weeks or more past due.

States may choose a lower limit. Check with your state to determine exact limits.(About two-thirds of the states use the federal limits, and about one-third cap the withholding at 50% regardless of second families or arrearage amount.)

Virginia Follows the CCPA - so it will be between 50-65% of the paycheck, depending on your situation (is the obligor supporting another family, is the obligor in arrears, etc.)
