Does my employer still have to pay a workers comp claim if I quit?
Find answers to your legal question.

Does my employer still have to pay a workers comp claim if I quit?

They have cut my hours by a third, and have put me on graveyard shifts, which make it so I can't take one of the medicines my doctor put me on. I am just trying to see if I can quit and try to find something else that would pay me better, as I have not been able to pay my basic bills in about a month.
Additional Details
I work in Nevada

I am an Advocate. I suggest that you should write a letter to your employer along with the medical report and demand proper working hours and pay. If this is not acceded to by the employer, he will be committing an illegal act, paving way for right to demand compensation !!

If you are injured while you are still employed that injury would still be covered by workers comp after you quit (i.e. your claim would remain open.) Any new injuries after you quit would not be covered.

It depends on which state you are in...which state are you in?

See this website (for Colorado):
http://www.coloradoworkcompattorney.com/dontquit.htm
* According to the Colorado workers compensation law, if you quit your job you could lose your workers comp claims to temporary disability benefits. Temporary disability benefits are the workman’s compensation benefits that compensate you for any loss of wages incurred while you are off work and receiving medical treatment. Before you take any action, especially deciding to quit your job, call Colorado workman's compensation attorney Tim Guill and set up a free initial consultation to discuss what course of action is in your best interest.

* It is an unfortunate reality that in order to avoid liability for workers comp claims under the workers compensation laws, some employers will make up reasons to terminate you or force you to quit -- and make it look like it's your fault! Don’t let your employer force you to quit. An employer understands they can save money and not pay on workers compensation claims by making up reasons why your employment was terminated. If you feel you are a victim of this fraud, call me now to see what you can do to best protect your rights under the workers compensation law.

* Medical benefits are the part of the workers comp claims that cover the costs of the medical treatment you receive as a consequence of your workman’s compensation injury. According to the Colorado workers compensation law, your employer has the right to designate the doctor (or doctors) who will provide you with medical treatment. This physician will be a "specialist" in providing workers compensation treatment for injured workers and is paid for by the employer’s insurance company. For this reason, these physicians are often more sympathetic to the insurance company than their own patients. More often than not, injured workers with workers compensation claims do not like or trust their workman’s compensation physician. However, according to the workers compensation state laws of Colorado, you have the right to receive an independent medical evaluation from a physician of your choice. As a Denver workman’s compensation attorney, I can help you exercise your right to an independent medical evaluation with a physician who can provide a fair and honest independent evaluation of your workers comp claims.

So, the important question is WHAT STATE DO YOU WORK IN?!

If you "quit" your are no longer covered by Workman's comp and you will not qualify for unemployment benefits.

well I was in a similar situation. I had to quit, they gave me meds I could not take while at work. nobody wants to go driving with a car salesman on vicodin.. They have paid me 33.00 since October. I could not get in and out of most vehicle to test drive - could not drive due to meds. So I quit.. my ankle healing correctly was my priority. I did physical therapy, 4 months later still no change in my Ankle. Work Comp attorney won't take the case as long as they have not contraverted the claim.( they can deny your medical payments but they have to notify you). I am scheduled for a independant medical eval this week. They are paid by work comp.. I am getting the shaft no matter what... Ankle is never going to heal correctly, They won't pay me squat on a PPI. I had to quit a job I loved. I would go back to trucking, but I can't hold the throttle down. So I am getting an office job.. do alot of reading on your rights..
