Does this sound suspicious?

I applied for a PSR ( Patient Services Representative) at a Medical clinic and after two interviews I was offered the job verbally on a Friday, and I called Monday to accept the offer. The gentleman asked me to come in and fill out some HR paperwork. ( prior to this I had not filled out anything). He also told me he was going to run a background check on me. Well 16 yrs. ago I was 18 and I was arrested becaused I had received a ride from this guy who had stole a car ( I didn't know). I was held for investagation and later released with no charges. Well I had a letter from the police dept. that stated the date and no charges and being the honest person I am I showed it to him and he then retracted the offer. Knowing I had already turned in my two wk. notice with my prev. employer. Also before I showed it to him he did mention that the back ground check only went back 5 yrs. My old position has been filled .

So, now I'm unemployed and I feel like a failure, but can he do that

Well he did. I don't know if it was legal, but he did. I would leave that incident in the past where it belongs. These idiots that decide who to hire (sorry, not all are idiots, just some) don't realize that they are doing the company a huge injustice by deciding not to hire a good employee just because of what you showed him! The people who make those bad decisions should be walked to the door! They obviously do not have the company's best interest in mind. Well good luck to ya.

I am sorry that you showed him that document.

You are not required to reveal arrests to employers, only convictions, so that would not show on your record.

You were not even charged.

I also was arrested at 18, and charged, but not convicted and my lawyer told me I did not ever have to reveal that to an employer.

contact labor board ask them what kind of case if any they can tell you best!

Sorry about the situation. You should get offers in writing. Because he made the offer and you accepted, but you don't have proof. If none of the paperwork required you to provide this information, then you should have kept it to yourself.

He may have considered it not being truthful, but really he was being a pain.

The answer is, no, he can't. It is legal to deny employment on the basis of a felony conviction, but not on the basis of a 16-year-old arrest with no follow-on conviction.

Next time, don't be quite so honest - most background checks only go back 5 - 7 years.

Get a lawyer now. Stop waiting for another answer on here. Even REAL ex-convicts have rights, you didn't do anything so you have even more rights! There was no reason he could do that to you. Unless you simply weren't qualified...
