I posted about this, but its getting worse. My results will be faxed with my name, SS# and with results...I am using a prescribed drug I don't want anyone to know about..The person testing me will be my co-worker..as we are a clinic that does drug testing..Now the Boss lady wants us to undergo testing. Everyone there looks at the faxes & I believe that is an invasion of my privacy! Yesterday I found out that she is only testing 1/2 the company..which is discrimination to me. Heres my legal questions: Isn't my results private? and isn't that discrimination if you only test 1/2 of a Company?
Is there anyone out there who knows the law?

all tests are confidential, as are the results, and they are breaking the law, when not keeping it that way!! |

Sounds like you may have something to be worried about!
But yes, all results are private or they could be fined. |

anyone can be drug tested at anytime, there is no discrimination involved, however in your case if you test positive you have to reveal the the prescription # and the pharmacy to the MRO |

Random drink and drug testing is admissible by law if the job requires it,ie The armed forces,police,train drivers etc,if your company feels that being clean and sober are requirements then you will just have to go with it,although if you were singled out you would have grounds to challenge the testing,
As for the confidentiality of the results this must be paramount and followed to the letter the company`s policy and law on confidentiality of employees and customers records, |
