Employer putting an employee in health danger?

My daughter is working at a home improvement center. and they put her outside in the garden section in 90+ degree heat. She had a mild heat stroke and had an episode that turned out to be MS. Until then she had no symptoms of MS. And was healthy. This turned into a 7 day hospital stay. Can We sue her employer for putting her health at risk?

sorry to hear about your daughter but look the company did not put the employee in any danger -- 90 degree heat is not unusual -- did she clearly indicate when she took the job that she could not work out side in the heat!!!

No, because the MS was not medically diagnosed PRIOR to her working there nor were they aware of it.

There are alot of people that work day in, day out, in 90 degree weather. I know for a fact that Home Depot allows and PROVIDES drinks for outside workers to help with hydration.

They are not responsible.

No, 90-something degree heat is not anything unusual in most parts of the country.

MS is often made worse by heat, but it doesn't cause it. Sorry, she already had it, it just wasn't obvious yet.

Communicate with letter to have documentation otherwise threatening to sue will create a hostile environment. If enough people whistle-blow anonymously,a useful tactic. No business desire negative publicity.
