My son worked for a construction company as a self employed worker, unfortunately he had to wait 4 weeks for his UTR number, which meant that the company could not keep his job open for him now he has his UTR no and the company are now refusing to pay him for the 5 days that he had originally worked for them. Can they do this ? .

There's not much you can do, there's no reason they could not pay with out the utr but you pay 30% tax with out it and 20% with it.
every self employed bulider i know has at some point not been payed work the've done.
All he can do is keep trying. |

Call the departent of labor, ask them to send you a " wage claim form" fill it out, and , send it back to them. they will send your sons employer a letter stating that they have a chance to pay lost wages or your son may pursue legal action. this 99% of the time scares them into paying, and its FREE for you. i've actually done this before and it works like a charm. good luck. |

I would contact the Labor Board. I think it is illegal to even have him on the job site. First get some information from them and ask what your options are and then you may have something over the companies head where they would be more than happy to pay instead of a bunch of paperwork falling on their desk. |

the construction trade is a joke at the minute, they are treating the trades and labour like dirt. you didnt say what age your son is or what he worked as on-site, but i'll take it he was a labourer. if thats the case i would advise him to get the hell out of construction now! do gardening, odd jobs anything other than labouring for a construction firm. i wasnt just treated like dirt i was treated like scum!. i dont know how your son stands legally, CAB best bet for proper advice. i'm on the construction skills register (a legal requirement to be assessed) as a skilled labourer. i'm one grade below a foreman and i get paid just above minimum wage but i do the work of 5 men. its knock em up fast and pay as little as possible to do it. thats construction for ya!. |

Yes they can, and the only thing your son can do is to sue them which is very expensive if he lost the case. There is no other redress for this matter. |

your son can claim his work time to the local magistrate and tell him or her what happened.. best i can do hope it helps |

He should threaten legal action via the small claims court.
Send letter stating amount owed and give time limit of 2 weeks from date of letter before court action will be taken.
Explain that court costs will be added to claim.
