Employment Contract - Conflicting Terms, Probabtionary Period & Notice?

My fixed term employment contract has two conflicting express terms
Section 6 advises as there is no probationary period under this contract, there is no entitlement to Occupational Sick Pay for the first 6 months of this contract
Section 10 advises that you are subject to a three month probationary period. During this time you and/or the company reserve the right to terminate your employment on shorter notice of 1 weeks notice in writing. The company reserves the right to extend the probationary period at its discretion.
Following successful completion of the probationary period, the period of notice for both Company and employee increases to 4 weeks.
Had 10 days certified sick given 1 wks notice and FTC was terminated.
Where do I stand if one term says there is no probationary period but the other says there is, and how does this affect the notice period? Which term overrides and does it mean I can get them to pay me in lieu for 3 wks notice as only gave me 1 wks notice?

Probationary Periods last between 1 and 3 months, during which time either side (you or the company) ONLY has to give 1 weeks notice.
You don't say how long your fixed term contract was for, or how far into it you were.
While you are doing the Probationary Period you are NOT allowed any days of sick, regardless of Doctors Note. |
