My manager requested a meeting with me today, and regrettably handed me a letter that states that after 5 months of my employment i am required to attend a meeting on monday, where a decision will be made on my continued employment.
It states that because the of the unforseen financial events of late, which is beyond their control, that has affected the company's ability to continue with my employment.
- Im confused!
Firstly, can they do this? I have a contract that states that my probationary period is 3 months. The fact he wrote 5 months in the letter is odd.
Can they use the financial crisis as an excuse? With this in mind, they have just employed 2 in house trainers on £48k each a year - without divulging to much info, their job is NOT what im employed to do but they have taken on some parts of my expertise when training (which ultimately means they *can* do my job if needed)
He said to me, although it doesnt state in the letter - that he will discuss other job opportunities with me next week. What kind of job can he offer me? Does it have to be something along the lines of what im doing at the moment, with the same pay rate?
Additional Details Hi - No i dont work for woolworths but I feel i should mention that the contract i work for, is up for tender - I have a feeling that we are not going to get the contract because we have been under cut by a rival company and i feel that this is the reason i have been put in this position - So the company can re bid at a lower price, knowing that they wont have to pay my wages and will therfore save a lot of cash. I feel my job has been taken away just so they can win the new contract!

They could say this is redundancy - however, as you've been there less than 2 years you would not be entitled to any redundancy money in the UK - only your notice period.
Unfortunately, if they are streamlining the business and combining 2 jobs then there really isn't anything you can do about it I'm sorry to say.
As you haven't been employed for a year you wouldn't be able to take to a tribunal for unfair dismissal either.
Go to the meeting with an open mind and ready to have a reasonable discussion. If you have any other good ideas on cost cutting you could also raise these. You could be offered any job within the company that you are qualified to do, and no, it wouldn't have to be on the same pay. Its up to you whether you agree to it or end up unemployed.

Many companies are going through this at the moment.
Sounds like you are going to be laid off, but there are things that you can learn to defend and protect yourself.
Go onto the acas website and educate yourself on redundancy lay off's they have so many information pages on what has to be done legally in situations like this.
They may offer you another role which may mean a change of contract so you will need to read up on that as well.
does your employer employ temps? realistically your company should be looking at laying those off first and the redistributing the work.
Sign of the times I'm afraid.

Unless your contract was written on the dark side of the moon, it'll usually have a clause which states that if the company experiences financial hardship they can review your contribution to the company and let you go or redefine your position if that contribution is not shown to be on the side of profit. If that were to happen, your contract would likely be renegotiated and you may get more or less depending on the expansion of your role. Review your contract with a lawyer but chances are you're out of luck. |
