Employment Law Question?

Here is the situation: we went from getting paid every two weeks to getting paid once a week. The last full check that we got was on sept 14th for the prior 2 weeks. Today (25th) we got a check that covered the 8-15th. The employer said that they can withhold a check- but i dont think they can, especially since we have been working there for well over 2 years.

From my calculations they should have paid us on the 18th for the prior week and on the 25th (today) for last week. Our original pay date would have been this Friday.

Am i overreacting or is that something that should be taken up with a lawyer? I know the company is having $$ issues right now, but we should still have been paid irregardless correct?

I just wanted to clarify- if we were still on every 2 weeks pay, we would have been paid this Friday. the check that they gave us on the 25th should have been given to us on the 18th and the hours we worked lst week should have been the check we received on the 25th.

the check we had gotten on the 25th should not have been held for 11 days if we went to weekly pay over 2 weeks ago.

so basically, likke i said, if we would have been still on every two weeks, this friday we would have receiveed a full check- instead for the past 3 weeks it is only covered one of those weeks..

hopefully i am not being too confusing!

Withholding means that you're paid the week following the pay period. For instance, your pay period is Monday to Saturday, you're paid for that pay period the following Friday which means you'll have to go back to pick up your final check after you quit. It's not only legal it's pretty much the way business is done.

Well the problem is about how long it takes them to settle their debt.

Most employers now pay promptly, sometimes even allowing people to fill in time sheets for work a few days in advance.

They are waiting 10 days to pay you for the work, but you are still getting paid.

How long they can delay before paying you depends on many things, local law and what is written in the contract.

While delaying the payment produces some hardship for the employees, from now on I would expect you are paid regularly. Fighting this would make little sense, because it is already over.

If you have some financial difficulties because of the delayed payment you might talk to your manager to see about getting paid earlier.

I would certainly talk to one and see what they think.The only time i've heard of a company holding a check is for the first week you work.Talk to some of your co-workers and see what they think.

Here is the issue: Have you known very many people that have "taken up issues" with an attorney that are STILL employed?

If you want to lose your job, then go ahead and call an attorney.

You went from getting paid every TWO weeks to every week, and you are upset because they want to delay issuing of checks for a week...when NORMALLY you would have had to wait another week anyway?

Yes, you are overreacting. You need to button your lip or you won't have to worry about when you get your paychecks.

Some things aren't right, but you just have to keep quiet about.
